“REKRIND” EOOD is a company registered as a personnel selection agency pursuant to Art. 5, item 1 of the Ordinance on the terms and conditions for carrying out employment mediation activities.

The company strives to ensure an appropriate level of security of personal data, processing them only for legally permissible purposes and with legally permissible means in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 year on the protection of natural persons in connection with the processing of personal data and on the free movement of such data (General Data Protection Regulation – “GDPR”).

This privacy notice provides information on how “REKRIND” EOOD collects and processes personal data in the course of its employment mediation activity, as well as on the rights of job seekers in relation to the processing of their personal data.

2. Data We Collect

We collect personal data about you in various ways, such as through our site, from our recruitment partners, from public information platforms for job seekers (eg: jobs.bg, zaplata.bg, etc.), social network channels (eg. Facebook and LinkedIn etc.), through events, by phone or email, through job applications and in connection with personal recruitment and in the course of our relationships with customers and suppliers. We may collect the following types of personal data:

1) identification data (name, gender, date of birth);

2) contact details (address, telephone number, e-mail);

3) information about education, skills, professional experience, command of foreign languages ​​(acquired qualification degrees, participation in trainings and courses, previous employers and positions, etc.);

4) information provided through references, information from conducted interviews, tests, face-to-face and remote communication conducted within the selection procedure;

In general, we do not collect and process special categories of personal data, but in some cases this may be necessary in connection with our services that you use. For example, we may need to process information about your health that is relevant to your job application. In such cases, we will ask you for your express consent. Please do not provide special categories of personal data without first giving your express consent.

A National Identity Number (NIN) is provided in connection with the conclusion of an intermediary contract between the Company and the jobseekers.

Attention: We recommend that you do not include in your resume data related to racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties or organizations, associations with religious, philosophical, political or trade union goals; as well as information that relates to the health and sex life of the natural person. These are “sensitive data” that do not relate to the subject of the selection and are not needed by the employers and the Employment Agency. We warn that it is risky and for the purposes of our service, essential data from identity documents such as social security number, passport/identity card number, validity periods, etc. should not be provided.

Data collected by automatic means: The RECRIND website collects a series of general data and information when a data subject or an automated system calls up the website. RECRIND analyzes anonymously collected data and information statistically, in order to increase the data protection and data security of our enterprise and to ensure an optimal level of protection of the personal data we process. Anonymous server log data is stored separately from any personal data provided by the data subject.

3. Grounds for processing

3.1 On the basis of a contractual relationship – this basis arises when we contact you in connection with your document-approved application, according to our recruitment advertisement for which you have applied. In order to be able to assist you in front of employers, it is necessary for us to enter into an Employment Mediation Agreement with you, which is our legal obligation to the Employment Agency (EA).

3.2 On the basis of legitimate interest – this basis arises when you submit a CV to our advertisement, but you do not fully meet the specified requirements on paper.

When we contact you, in connection with suitable job offers for your profile and preferences, you will be processed according to3.1;

On the basis of explicit consent – when applying for a job in front of a particular employer processing personal data of the relevant applicant in this connection as well as in other cases where necessary, will be based on the consent of the jobseekers for one or more specific purposes. This reason also arises for all candidates who are already in our database, on the basis of 3.1 and 3.2, after the expiration of the processing period declared above. We will contact you to obtain your express consent or refusal to future processing of your personal data for the purposes of selection and career counseling.

On the basis of compliance with a legal obligation – As a registered intermediary “REKRIND” EOOD has a legal obligation to provide information, including personal data, to the Employment Agency.

4. Purposes and manner of use of the information we collect

“REKRIND” EOOD processes the personal data of the jobseekers for the purposes of carrying out mediation activity on employment. This activity consists in assisting, informing and consulting job seekers and employers offering vacancies, with the aim of assisting both parties in the selection and hiring procedure.

More specifically, the personal data of jobseekers is used for the purpose of finding suitable job positions and applying for work in front of the respective employers.

The specific actions to realize the purposes of the processing could include: storage and search in the database; assessing the suitability of jobseekers as candidates for employment in front of relevant employers (without using automated decision-making); provision of personal data to relevant employers; communication on the occasion of the intermediary services used by the persons, incl. sending notifications of vacancies, various notifications, responses to inquiries, requests for feedback;

We may also use the information in other ways for which we provide specific notice at or before collection.

5. Storage and updating of data

We will retain your personal data only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of complying with legal, accounting, tax or reporting requirements.​​​​​​

When deciding on the exact period of data retention, we take into account its volume, nature and sensitivity, the potential risk of harm from unauthorized use or disclosure, the purposes of the processing if they can be achieved by other means and legal requirements.

In some circumstances, we may anonymize your personal data for research or statistical purposes, in which case we may use this information for an unlimited period of time without further notice to you.

Mediation contracts concluded with jobseekers are kept for a period of 5 (five) years in accordance with the requirements of the Ordinance on the terms and conditions for carrying out mediating activity on employment. The storage of personal data in the Company’s database is determined by the validity period of the mediation contracts.

When the personal data is necessary for the Administrator to make legal claims or defend against such, the same will be stored until the relevant claims are settled. The administrator reserves the right to store data in an anonymized form.

We are committed to updating your details by contacting you to provide you with the best career opportunities.

Where you have provided data for recruitment and career counseling purposes based on consent, you may withdraw your consent at any time and we will securely delete it.

6. Data we share

We do not disclose the personal data we collect about you except as described in this Policy. We share your personal data with clients who may offer suitable employment opportunities or wish to offer employment to our job candidates.

We may share your personal data with companies acting as our subcontractors for the purposes of fulfilling our duties as a recruitment agency: IT providers whose servers are located in Europe, applying the European Commission’s standard contractual clauses – for the purposes of development and technical support of our systems; auditors and consultants to check our compliance with external and internal standards and requirements. All persons processing personal data are carefully selected and checked for compliance with GDPR requirements. Confidentiality and non-disclosure agreements have been concluded with them.

We may also disclose information about you (i) if required to do so by law or legal process, (ii) to law enforcement agencies and government officials based on a lawful request for disclosure, and (iii) in cases where you believe it is necessary to prevent personal injury or financial loss or loss in connection with an investigation of suspected or actual fraudulent or illegal activity.

We also reserve the right to transfer personal data about you upon the sale or transfer of all or part of our business or assets (including in the event of restructuring, termination and liquidation).

Your Rights and Choices

You have the following rights under the GDPR:

1) to withdraw your consent at any time (when the processing is based on consent);

2) to object to the processing of personal data (when the same is based on a legitimate interest);

3) to access, correct or delete your personal data;

4) restriction of processing;

5) portability of your personal data (if the legal prerequisites for this are present);

6) of a complaint to the Commission for the Protection of Personal Data (Sofia 1592, “Prof. Tsvetan Lazarov” Blvd. No. 2; www.cpdp.bg).

Data Transmission

We transfer the personal data we collect about you only in the territory of the European Economic Area (EEA) or Switzerland, and we will comply with the applicable legal requirements to ensure the appropriate protection when transferring personal data to recipients in countries outside the territory of the EEA and Switzerland.
